1. Acceptance of Terms
Welcome to Kitchennetch j.d.o.o. (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms,” “Agreement”) govern your access to and use of our website, www.kitchennetch.com (the “Site”), and all related content, services, and products (collectively, the “Services”) purchased through the Site.
By accessing, browsing, registering an account, or making a purchase on our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund and Returns Policy, and our Shipping Policy. If you do not agree to all these terms and conditions, you must not access or use our Services.
Our mission is to help you Chop, Cook, Create. We provide innovative kitchen gadgets designed to help you prep faster, cook smarter, savor more by turning tedious prep into culinary joy. These Terms outline the rules for using our platform to access these products.
2. Eligibility
The Services are intended for users who are at least 18 years of age or the age of majority in their jurisdiction, whichever is higher. By using the Services, you represent and warrant that you meet this eligibility requirement. If you are under the required age, you may only use the Services with the involvement and consent of a parent or legal guardian.
3. Account Registration
To access certain features, such as placing orders or viewing order history, you may need to create a user account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information.
- Maintain the security of your password and accept all risks of unauthorized access to your account.

We reserve the right to suspend or terminate your account at our sole discretion if we suspect any fraudulent, abusive, or illegal activity.
4. Products, Orders, and Purchases
- Product Information: We strive to display product colors, features, specifications, and details (including pricing) as accurately as possible on the Site. However, we do not guarantee that your monitor’s display or product images are perfectly accurate. All products are subject to availability. We reserve the right to discontinue any product at any time.
- Pricing: All prices are listed in Euros (€) and include applicable value-added tax (VAT) for Croatia. Prices are subject to change without notice. We reserve the right to correct any pricing errors that may occur inadvertently.
- Order Acceptance: Placing an item in your cart or completing the checkout process constitutes an offer to purchase. Your order is not accepted until we send you an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in product or pricing information, suspected fraud, or an irregular order.
- Payment: You agree to pay all charges incurred by you or users of your account at the prices in effect when such charges are incurred. We use secure third-party payment processors. You represent and warrant that you have the legal right to use any payment method you provide.
5. Shipping, Returns, and Refunds

- Returns & Refunds: We offer a 30-day return policy for items in new, unused condition with original packaging. We emphasize that a physical return of the item is mandatory for any refund to be issued; “refund-only” resolutions are not permitted. Return shipping costs are the customer’s responsibility unless the return is due to our error. A restocking fee may apply for non-defective opened items. 6. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof), as well as our brand name “Kitchennetch,” logos, taglines (e.g., Chop, Cook, Create; Prep faster, cook smarter, savor more), and product designs, are owned by Kitchennetch j.d.o.o., its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Site, except as incidental to normal web browsing or as necessary to place an order.
7. User Conduct and Prohibited Activities
You agree not to use the Site or Services to:
- Violate any applicable local, national, or international law or regulation.
- Engage in any fraudulent or deceptive activity.
- Infringe upon or violate our intellectual property rights or the rights of others.

- “As Is” Basis: THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- Product Use: OUR PRODUCTS ARE KITCHEN TOOLS AND GADGETS. YOU AGREE TO USE THEM RESPONSIBLY, IN ACCORDANCE WITH THEIR INTENDED PURPOSE AND ALL ACCOMPANYING INSTRUCTIONS. WE ARE NOT LIABLE FOR ANY INJURY, DAMAGE, OR LOSS RESULTING FROM IMPROPER, NEGLIGENT, OR UNINTENDED USE OF OUR PRODUCTS.
- Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KITCHENNETCH J.D.O.O., ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY PRODUCTS PURCHASED OR OBTAINED THROUGH THE SERVICES; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
- Maximum Liability: OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU HAVE PAID US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9. Indemnification
You agree to defend, indemnify, and hold harmless Kitchennetch j.d.o.o., its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms.
10. Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts located in Varaždin, Croatia. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect, such as by posting a notice on our Site or sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
